Will the Court of Justice of the European Union step in on the Prisoners Votes Case?

A main change brought about through the Lisbon Treaty includes the introduction of an emergency procedure at the Court of Justice of the European Union, which will allow the Court to act with a minimum delay when a case involves an individual in custody.

I believe that the interpretation relates to liberty of the subject in relation to such as false arrest and false imprisonment.

What about the human right and liberty to vote of those convicted prisoners, especially given that the coalition may not last 5 months let alone 5 years?
