Dogs of Law (Part 2)



Just got back from the magistrates court in relation to this case. Bottom line the trial has been postponed for a month, to allow me to submit a skeleton argument of my legal points to the CPS. The CPS had failed to serve the statements on me, within the time limits allowed, thereby denying me knowledge of the case I had to meet.

My solicitor, Ian Phillip, of Amber Solicitors, also raised the issue of abuse of process. That is, the argument that the CPS does not have jurisdiction to prosecute in this case. Even the magistrate was questioning this point himself. My solicitor told him, "You have hit the nail on the head".

Either way, it looks like the point of law will have to be decided by the High Court in London...
