BBC/Jeremy Vine/ Paul Staines/Guido Fawkes/ Gawain Towler libel update

Following on from my original posts here, I have emailed the BBC Legal Department and have been informed that a transcript of the interview is now being examined by libel lawyers.

Meanwhile, Paul Staines/Guido Fawkes has been busy attempting a damage limitation exercise by changing "Axe-murderer" to "Axe-killer" in some of his post titles but the libel remains in some posts and is still visible in the url's.

It is worth pointing out that damages are greater where it can be shown that the libel was done with malice, as in the case of Paul Staines/Guido Fawkes.

The intervention by UKIP's press spokesman in Brussels, Gawain Towler, is odd to say the least. It does not assist Paul Staines/Guido Fawkes' case, and only means that he now too becomes a defendant along with the BBC, Jeremy Vine, Paul Staines/Guido Fawkes/Guy News and also discredits UKIP by bringing the organisation into disrepute if that is possible.

    He did the same thing you and many other bloggers do, he stood up and said he felt what you were doing was wrong and said why, while mocking you.

    Funnily enough, he wasn't swigging champagne and smoking a spliff at the time, he just said it, but you know, different people do different things.

    He just said he thought they weren't wrong, same way many hve done for you. Hush man.

  2. Isn't the burden of proof reversed in libel cases? How is Staines going to prove that his 'murderer' comment is true when no conviction for murder is present?

    Murder requires mens rea as well as actus reus.

  3. The onus is upon him to prove his statement is true. He has not got a legal leg to stand on. Because there was not the necessary mens rea in my case the charge was reduced to manslaughter. First Paul Staines did car crash TV on Newsnight, and now car crash radio on Jeremy Vine...
