Plod

Plod

I have just received a phone call from the local CID in relation to a complaint they have received that my blog has racist content and I am to be interviewed under caution.

UPDATE: Racism

And the politically correct police

guide to the application of the law to racism on the Internet

Opening up a can of worms...

November 9th Society

Mr. Dismore: To ask the Secretary of State for the Home Department if he will take action to close the website of the November 9th Society; and if he will make a statement.

Fiona Mactaggart: The Government condemn those who use the internet to distribute racist material of this kind. The law on incitement to racial hatred applies to material on the internet which comes within our jurisdiction. It is for the police to investigate complaints and decide whether there is evidence that website operators have committed offences
The Internet Watch Foundation serves as a central point of contact for those who wish to report examples of inflammatory material on the internet.
The Government are currently working on an e-crime strategy which will include consideration of racist material on the internet.

WTF!? I read your blog regularly and I don't remember ever seeing anything racist. Someone must have it in for you.

Bob: It will be if Blaney, or whoever is behind this, gets me locked away again.

I hope the police charge whoever it is with wasting police time.

But surely as a solicitor you can defend yourself? You ARE a solicitor aren't you..?

Let me ask a fair and straight question of Donal Blaney, just to give him the opportunity:

Donal, are you in any way responsible for the complaint JHL refers to, or are you aware of someone who is?

(No weasel words because you only know the nickname of who did it or because your secretary placed the call or sent the email etc., please.)

Hi Donal if it is really you and not someone impersonating you. What I liked about the prison governors who dared to challenge me was their arrogance. They believed they were in charge of the situation. However, my case was based upon what the invisible judge looking over his shoulder would make of it all. And then when the legal papers were served I would watch them squirm. It was a joy to watch. Not out of sadistic delight but because I had proved them wrong and myself right.

A lawyer who represents himself has a fool for a client, adage says

I don't remember seeing anything racist on your blog!!!

There are certain other bloggers who 'think' they are the pillars of society who I find quite offensive because of the discriminatory remarks they make (no one seems to comment on them)...

Cherrypie: Thank you for your words of support. I hope more of the others either come out for or against me to see who and what is behind the accusation(s).

Hello Tim: I am happy to give the straight answer you asked for :)

No and no.

So are you a solicitor, Jailhouselawyer? Or a barrister?

Tim said...

So you're just taking joy in the situation, and you're here to gloat.

Comforting. To an extent.

I enjoy John's blog.
I have seen plenty of things that I think are pretty questionable.

Plenty of these things may be considered to fall foul of the imposed legislation which seeks to stop our ability to question the government.

None of these things would stop me sitting with him and having a beer while we 'righted' the wrongs of the world.

More power to his elbow.

Stop John speaking, you stop me speaking, you stop us all speaking.

Don't like what is on TV? - change the channel.

jailhouselawyer said...

Donal Blaney: What's your point? I am neither a qualified solicitor nor qualified barrister. Nevertheless, I am a lawyer.

Merkin: Thanks for your support, as always.

If you're a racist, then I'm Robert Mugabe.

AProlefrom1984: Cheers for your support, Bob, I will now support your regime:)

What utter nonsense, someone has an axe to grind. It's a shame the plod didn't have a quick look at your blog before calling, they might have saved the phone call.

It is a shame whoever has the axe to grind doesn't have the balls to openly air their grievance here rather than anonymously inventing ludicrous allegations to the police.

You keep a great blog and you have my support.

richard.

How are you qualified as a lawyer if you are neither a solicitor nor a barrister?

Richard: bad phraseology...

jailhouselawyer said...

Donal Blaney: Stop trying to trap me into claiming that I am a qualified lawyer. I clearly state I am not qualified. Nevertheless, I am still a lawyer. As I frequently beat qualified lawyers in court, the qualification is not worth the paper it is written on. What counts is a winning track record.

John, it seems to me that Mr Blaney misunderstands the term lawyer which is a generic term for people studying and/or practising law. Professional lawyers, ie. qualified lawyers are baristers/solicitors/legal executive and judges. This does not prevent others from calling themselves lawyers. You have made it clear that you are the jailhouse lawyer. This says it all. Someone who, despite having the ability, will never obtain the qualification because of his record. Pity. Your knowledge of prison law is, of course, second to none. Your understanding of the law in general is also sophisticated, much more so than the lay person. The problem is that some people cannot see beyond the qualifications. I must say that as a practising (and successful) barrister (yes, qualified), I have found that the level of expertise of 'lawyers' who send me instructions varies not according to qualifications but according to the individual. In other words, a qualification alone is worthless without knowledge, understanding and motivation...
Keep up the good work, I too enjoy your posts even if you have to draw them to my attention!
