Damages for parents in care case

Damages for parents in care case

A British couple whose two-month-old daughter was taken into care after a "misguided" suspicion of abuse have been awarded £8,000 in compensation.

The European Court of Human Rights ruled their rights had been infringed because they had no legal redress for the loss of their child.

The girl, from Oldham, was taken into care in 1998 after breaking her leg.

The family was reunited nine months later when another injury revealed that the girl had brittle bone disease
.

In spite of the Human Rights Act 1998, and reforms of Judicial Review, this case shows that the UK still has a misguided sense of what British justice should mean.

jailhouselawyer,

It will remain so until labour and it's obsession with 'targets' is ousted.

A return to commonsense is long overdue. Congratulations to the parents for standing their ground;
highly traumatic for all concerned.

There have been equally appalling
accounts of new born babies being taken for adoption without justification. Can you imagine anything worse ? Targets ....
civil servants are blinded by targets.

Doesn't sound like all their costs were met, to begin with. What abour families who do not have the funds to go to Court?
This is why I believe that more lawsuits and threat of, protect rather than injure people. Makes people think twice when they know they could be held accountable.

Compare this couple to Kate and Gerry McCann.
Quite absolutely remarkable.
Astonishing actually.
