Bullshit! Israel isn't guilty of war crimes for bombs accidentally hitting the home next door to their target. It's horrible. I am very sympathetic to the families. My heart goes out to them.
But the war crime is Hamas using human shields in the hopes that events like this will happen! Hamas wants this to happen, Israel is trying to avoid it.
Of course Israel is guilty of this bomb attack killing 5 innocent civilians. Hamas did not use these innocent victims as human shields. Israel could have avoided this by not firing the rocket in the first place.
Yeah, Israel could have not fired the rocket, but their firing of the rocket doesn't make it a warcrime! Yes, Israel killed the five innocent civillians and it's a tragedy. But if it was unintentional and not reckless, it's not automatically a warcrime!
Hamas DID use them as human shields. The article you linked to pointed out that the mosque next door was named after the former leader of Hamas's military (AKA terroristic) wing, and there were four terrorists inside. Four terrorists next door to civillians, and that's not using them as human shields? Hamas doesn't have to literally be grabbing civillians and holding them over their heads to constitute human shields-fighting from civillian areas is also use of human shields.
